Conflicts of national law in relation to international transactions

  • Divergence in national laws relating to international transactions

Nature

With the increase in international travel and interaction, there is a corresponding increase in the injustices resulting from the divergent laws of different countries which have some connection with such international transactions. Individual rights and interests ranging from the rights of married women and child custody to the amount of compensation for personal injury or breach of contract may ultimately turn on the person's geographic presence at an isolated moment in time or the country in which the person first seeks to protect his or her rights and interests.
